Terms of Service
These Terms of Service govern your use of the Toy Soldiers Platform. By accessing or using our service, you agree to be bound by these terms.
1. Acceptance of Terms
By registering for or using Toy Soldiers Platform ("Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform.
- You must be 18+ to use this Platform
- You are responsible for all activity on your account
- We reserve the right to modify these terms at any time
2. User Roles and Accounts
Creators
- Can upload and monetize original content
- Receive 85% of revenue (15% platform fee)
- Must comply with content guidelines
- Responsible for licensing and copyright
Fans
- Can purchase content and subscribe to creators
- Can tip and support favorite creators
- Cannot re-upload or redistribute content
3. Content Guidelines
Content must comply with our platform standards:
- No illegal content or hate speech
- No harassment, bullying, or threats
- No non-consensual intimate content
- Adult content requires proper age verification
- No copyright infringement
4. Payment Terms & Fees
Creator Earnings: Creators receive 85% of net revenue. We retain 15% as platform fee.
Payment Processing: All payments processed through Stripe. Additional Stripe fees may apply.
Minimum Payout: $100 minimum balance required for payout.
Payment Schedule: Payouts processed monthly on the 15th.
5. Subscriptions
Auto-Renewal: Subscriptions automatically renew unless canceled.
Cancellation: Cancel anytime in account settings. Cancellation takes effect at end of billing period.
Refunds: See our Refund Policy for subscription refund eligibility.
6. Intellectual Property
Creator Content: Creators retain ownership of their content and grant Toy Soldiers Platform a license to host and distribute.
Platform IP: The Platform, logo, design, and features are owned by Toy Soldiers and protected by law.
License to Users: We grant you a limited, non-exclusive license to view and enjoy content for personal, non-commercial use.
7. Prohibited Conduct
You agree not to:
- Hack, spam, or abuse the Platform
- Download or republish content without permission
- Engage in fraudulent payment or refund schemes
- Impersonate others or create fake accounts
- Harass or threaten other users
- Bypass our security measures or ToS
8. Moderation & Appeals
Content Removal: We may remove content that violates our guidelines without notice.
Account Warnings: Violations may result in warnings, temporary suspension, or permanent ban.
Appeals: You may appeal moderation decisions within 30 days.
9. Account Termination
We reserve the right to terminate accounts that violate these terms. Terminated accounts lose access to all content and funds.
10. DMCA & Copyright Policy
Copyright Violations: Creators are responsible for copyright compliance. We enforce copyright through the DMCA.
Takedown Notice: Report copyright violations at support@toysoldiers.com with details.
Three-Strike Policy: 3 valid copyright claims = permanent account termination.
Counter-Notification: Creators can dispute takedowns with legal counter-notification.
11. Dispute Resolution
Arbitration: Any disputes shall be resolved through binding arbitration, not court.
Opt-Out: You may opt-out of arbitration within 30 days of account creation.
Governing Law: These terms governed by laws of the state where our company is incorporated.
12. Creator-Specific Provisions
- Creators receive 85% of revenue; Platform retains 15%
- Minimum payout of $100 required
- Payouts processed monthly on the 15th
- Chargebacks result in fund deduction from creator balance
13. Limitation of Liability
To the fullest extent permitted by law, Toy Soldiers Platform is provided "as-is" without warranties. We are not liable for indirect, incidental, or consequential damages.
14. Changes to Terms
We may update these terms at any time. Material changes will be notified via email. Continued use of the Platform constitutes acceptance of updated terms.
